Overview

Course Description

The role of the legal team is to process the client’s bankruptcy efficiently and effectively through a daunting legal maze that is laden with traps for the unwary. This on-line session begins with a short discussion of the psychology of bankruptcy and how paralegals can assure clients that the fresh start afforded by a bankruptcy discharge is protected in our Constitution. The course will then discuss the initial interview process with emphasis on the importance of disclosure. Clients should be able to provide evidence proving the information supplied on the bankruptcy petition and the accompanying schedules. Clients who conceal and fail to disclose assets and income to the bankruptcy court run the risk of not only having their cases dismissed but also facing criminal fraud charges. The traps inherent in the use of social networking will also be highlighted along with sections on important matters related to the establishment of the attorney–client relationship in the bankruptcy practice.
